Welcome to Kama Health India LLP (“Company”, “we”, “our”, “us”).

These Terms of Service govern your access to and use of our website, mobile-accessible services, and online psychotherapy sessions conducted through digital platforms.

By accessing our website, booking a session, or using our services, you acknowledge that you have read, understood, and agreed to these Terms.

1. Nature of Services

Kama Health India LLP provides online psychotherapy services to individuals and couples.

• All sessions are conducted virtually via secure video platforms.

• We do not provide in-person therapy through this website.

• We do not provide emergency or crisis intervention services.

Therapy is a professional service and not a guarantee of specific results.

2. Eligibility

By using our services, you confirm that:

• You are at least 18 years of age, or

• You are a minor with valid parental/guardian consent where applicable.

We reserve the right to refuse services if eligibility criteria are not met.

3. Telehealth & Mobile Access

Our services may be accessed via:

• Desktop

• Mobile phone

• Tablet

• Other internet-enabled devices

You are responsible for:

• Ensuring a stable internet connection

• Ensuring a private, confidential environment

• Using a functioning audio-video device

Kama Health India LLP is not responsible for:

• Internet failures on the client’s side

• Device malfunction

• Environmental interruptions

• Loss of session time due to technical issues beyond our control

If technical disruptions occur on the therapist’s end, reasonable efforts will be made to reschedule or compensate proportionately.

4. Payments, Cancellation & Refund Policy

This policy sets out how payments, session validity, cancellations, rescheduling and refunds work for services booked with Kama Health India. It forms part of our Terms of Service.

Booking and payment

A booking is confirmed once full payment is received. All prices are shown at checkout before you pay. Payments are processed by third-party payment gateways, and Kama Health India is not responsible for delays caused by banks or payment processors.

Validity

Each session is valid for one year from the date of payment. Sessions not used within this period expire and are not eligible for a refund. The only exception is the validity extension described in Section 6.

Cancelling a purchase and refunds (14-day window)

You may cancel a purchase and request a refund only within 14 days of the date of payment. After 14 days, the purchase cannot be cancelled and no refund is available. Your sessions remain valid until the one-year expiry.

Used sessions: a session is "used" if you attended it, or if it is counted as used under Section 4, 5 or 6.
No sessions used: full refund, less payment gateway charges.
Some sessions used: refund for the unused sessions at the per-session rate you actually paid (not the discounted package average), less payment gateway charges.
Bonus and promotional sessions: these have no cash value and are not refunded.
Upcoming bookings: when you request a refund, booked sessions you have not yet attended are cancelled and treated as unused. The exception is a session starting in less than [24 hours], which is counted as used.
Sessions pending rescheduling: sessions awaiting rescheduling because of a therapist-side or Kama-side issue (Section 6) are treated as unused until they are delivered.
The 14-day window is fixed: rescheduling a session, or extending validity under Section 6, does not extend or reopen it.
Exceptions: the 14-day limit does not apply to refunds under Section 6 (undeliverable sessions) or Section 7 (no suitable therapist).

Cancelling or rescheduling a booked session

At least [24 hours] before the session: you can reschedule free of charge, and the session stays in your balance.
Less than [24 hours] before the session, or if you do not attend: the session is counted as used.

Late arrival and no-shows

If you join within 20 minutes of the start time, the session runs for the remaining time only. If you do not join within 20 minutes, the session is marked as a no-show and counted as used.

Technical and therapist-side issues

Issues on your side (internet, device, power or lack of a private space): the session is counted as used and is not refundable. Please check your setup before each session.
Issues on the therapist's or our side: the session is rescheduled at the earliest mutually convenient time. It is not counted as used, and nothing is deducted from your balance. If a session is cut short from our end, the remaining time is carried over.
Validity extension: if a rescheduled session would fall after your one-year validity ends, we will extend your validity by [30] days so that you do not lose it.
Undeliverable sessions: if we cannot deliver a rescheduled session before the extended validity ends, you will be refunded for that session at the per-session rate you paid, less payment gateway charges.

If we cannot serve you

If we are unable to match you with a suitable therapist, you will receive a full refund of all unused sessions at any time, regardless of the 14-day window.

How refunds are processed

To request a refund, email help.kamahealthindia@gmail.com with your name, registered phone number and payment details. We will respond within [3] working days. Approved refunds are credited to your original payment method within 7–10 working days, depending on your bank. You do not need to give a reason for your request.

Changes to this policy

We may update this policy from time to time. The version in force on the date of your payment applies to that purchase.

Therapist Assignment & Changes

Therapist allocation is based on clinical suitability and availability.

• While preferences may be considered, we do not guarantee assignment of a specific therapist.

• You may request a change of therapist provided there is no session scheduled within the next 24 hours.

• Kama Health India LLP reserves the right to reassign therapists when clinically or operationally necessary.

Confidentiality

All therapy sessions are conducted under professional confidentiality standards.

However, confidentiality may be legally or ethically breached in situations involving:

• Risk of harm to self or others

• Court orders

• Legal obligations under Indian law

Please refer to our Privacy Policy for detailed information regarding data collection and storage.

No Emergency Services

Kama Health India LLP does not provide emergency psychiatric or crisis services.

If you are experiencing:

• Suicidal thoughts

• Risk of harm

• A mental health emergency

Please immediately contact local emergency services (Dial 112 in India) or visit the nearest hospital.

No Guarantee of Outcomes

Psychotherapy is a collaborative process grounded in psychological principles. Outcomes vary depending on multiple factors including individual readiness, engagement, and external circumstances.

We do not guarantee specific results or outcomes from therapy.

5. Limitation of Liability

To the maximum extent permitted under applicable Indian law:

Kama Health India LLP shall not be liable for:

• Indirect, incidental, or consequential damages

• Technical failures beyond our control

• Decisions made by clients outside therapy sessions

• Misuse of website content

Your use of the website and services is at your own discretion and responsibility.

6. Intellectual Property

All website content, including text, graphics, branding, and materials, are the intellectual property of Kama Health India LLP and may not be copied, reproduced, or distributed without written permission.

7. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the courts located in [Insert City of LLP Registration].

8. Modifications

Kama Health India LLP reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
